There are two classifications of contaminated soil based on the contaminant:  Fuel Contaminated Soil and Nonhazardous Contaminated Soil (anything not fuel).  Application procedures are different for the different types.

Fuel Contaminated Soil

(soil contaminated with gasoline, diesel fuel, all types of heating oil, kerosene, jet fuel)

Procedures for disposal vary by volume and contaminant. In order to determine which procedures to follow, first calculate the volume of soil that you have by using the soil volume calculator. Project types are divided into two groups: <25 tons or 25 tons or more. 

Procedures for less than 25 tons:

• You will need to complete and submit a Landfill Application (Landfill Application Electronic version) - (Landfill Application Printable version) and a Non-Hazardous Waste Certification (Non-Hazardous Waste Cert. Electronic version) - (Non-Hazardous Waste Cert. Printable version)
• No sampling and laboratory testing will be required.  
• Once received, the documents will be reviewed to determine if the soil is acceptable for disposal and then submitted to DEP. When disposal has been approved, you will be notified and given information on how to proceed.

Procedures for 25 tons or more:

• You will need to complete and submit a Landfill Application (Landfill Application Electronic version) - (Landfill Application Printable version) and a DEP Form FC-1
• You will need to collect and analyze samples of the soil as described below.  Number of samples to collect:         
  • One sample representing the most highly contaminated soil, based on visual observation, plus
  • For up to 100 cubic yards of soil, one grab sample for each 50 cubic yards of soil or fraction thereof, and
  • For quantities exceeding 100 cubic yards, one grab sample for each addtitional 100 cubic yards of soil     (One cubic yard is approximately equal to 1.4 tons for conversion from estimated tonnage or measured pile sizes.)
  • Example: 300 cubic yards
    • 1 sample from the most contaminated soil
    • 2 samples for the first 100 cubic yards
    • 2 samples for the two additional 100 cubic yards
    • TOTAL: 5 samples
    • Analysis to perform:

• Contact your lab of choice for correct sampling procedures and containers.
• Once received, the documents will be reviewed to determine if the soil is acceptable for disposal then submitted to DEP.

Nonhazardous Contaminated Soil  

(soil contaminated with anything other than fuel)

  • less than 2,200 pounds (1 ton) contaminated with anything else

• You will need to complete a Landfill Application (Landfill Application Electronic version) - (Landfill Application Printable version) and a Nonhazardous Waste Certification (Nonhazardous Waste Cert. Electronic version) - (Nonhazardous Waste Cert. Printable version)
• No sampling and laboratory testing will be required.  
• Once received, the documents will be reviewed to determine if the soil is acceptable for disposal.
• When disposal has been approved, you will be notified and given information on how to proceed.

Procedures for:

• 25 tons or more contaminated with hydraulic oil, motor oil, antifreeze
• 2,200 pounds (1 ton) or more contaminated with anything else

• You will need to complete a Landfill Application (Landfill Application Electronic version) - (Landfill Application Printable version),  DEP Form U-CS, Nonhazardous Waste Certification (Nonhazardous Waste Cert. Electronic version), (Nonhazardous Waste Cert, Printable version) and Testing Reduction/Elimination Certification (Testing Reduction/Elimination Cert. Electronic version) - (Testing Reduction/Elimination Cert. Printable version)
• You will need to collect and analyze samples of the soil as described below.
  • Samples to collect:
    • One sample for each 250 cubic yards of soil
    • (One cubic yard is approximately equal to 1.4 tons for conversion from estimated tonnage or measured pile  sizes.)
